Are you currently Bar Certified? No

Position Applied For Paralegal

Discord Username Ms Moses#1016

Can you confirm that you have read the District Attorneys Handbook? No

Why do you want to be a prosecutor? I have had an interest in law for some time - however never really had the opportunity to explore it. I feel the city would be a great place to learn and as such I could then provide a service back to the people. (as a note i Have requested access to the DA handbook, but to date it has not been available)

Do you know who the district attorney is and have you previously had a conversation with them regarding the position? No

Describe the Giglio Rule Giglio material (Giglio v. United States, 405 U.S. 150) is a 1972 Supreme Court case involving the prosecution’s obligations in regards to criminal discovery and disclosure. This means that the prosecution is obligated to disclose all information or material that may be used to impeach the credibility of prosecution witnesses.

You are an ADA on a case and offered the defendant a plea of five years. The defendant rejected it and wants to go to trial. You receive a call the night before the trial informing you that your only witness just died of a heart attack. You come to court to tell the judge that you have to dismiss the case when the defendant's lawyer approaches you and says that they’ll take the deal. What would you do? As a prosecutor you must always ensure that the evidence is presented - to not reveal this change in circumstances could lead to an appeal in the future. In reality I would expect that you would make the information known - my expectation is that a written statement has already been provided and that could still be used as evidence

Many times law enforcement are certain that a particular crime has been committed by a defendant. What is your response if there is not enough evidence to stand at a criminal trial? I would advise the LEO why the evidence submitted was not appropriate and what else may be needed to proceed. Whilst their instinct may be correct - the courts must only deal in facts.

How would you handle a situation where a police officer wants a warrant signed or wants to file particular charges and you do not agree with his/her assessment? I would sympathize with the situation and take the time to explain to the officer why I didn't agree with their assessment - giving them the time to reassess what was submitted and see if further information could be obtained/presented that would allow for the charge/warrant to proceed.

As part of the District Attorneys Office, if you become a paralegal you are entitled to a free education in law with the San Andreas Law School. This voids the $43,000 enrollment fee, as such this would tie you into a 2 month contract upon passing the bar exam. Do you agree to this condition? Yes

Do you have any previous experience as a prosecutor? If so please detail this below. No i do not

Do you understand that if accepted as a member of the District Attorneys Office you will be expected to maintain a high level of professionalism as well as follow the law? You also agree to not share any confidential information you obtain as a member of the District Attorneys Office with any civilians or friends/family that are not employed within the District Attorneys Office. Yes

Apologies. I see I have written the wrong date. I can do either today, Thursday July 8th, or Friday July 9th. Regardless of the date and given your availability, does one hour prior to the storm work for you? Let me know which day you prefer.

Appreciated,

Juliette Pierce
