Position Applied For State Attorney

Discord Username Notey#6531 (Pending BAR Exam approval)

Can you confirm that you have read the District Attorneys Handbook? Yes

Why do you want to be a prosecutor? I started roleplaying as a Defense Attorney and I enjoyed it, but once I switched to the prosecution position I now know I enjoy it a lot more. The first time I was a prosecutor was on RivalryRP and after that I held the position on a couple servers afterwards. I really enjoy being on the state of the court room, you have so many resources readily available and easy to access. It also requires a lot more paperwork in my opinion which I enjoy.

Do you know who the district attorney is and have you previously had a conversation with them regarding the position? No

Describe the Giglio Rule The Giglio Rule came from a Supreme Court Case (Giglio v United States) which showed the prosecutions inability to explain to the Jury that a specific witness was promised not to be prosecuted for information given on the stand. This rule was created so if this situation ever comes up it is required to tell the jurors the circumstances so they know all of the details. This also implies to informing the defense as well on any agreement that may have been made with a witness.

You are an ADA on a case and offered the defendant a plea of five years. The defendant rejected it and wants to go to trial. You receive a call the night before the trial informing you that your only witness just died of a heart attack. You come to court to tell the judge that you have to dismiss the case when the defendant's lawyer approaches you and says that they’ll take the deal. What would you do? I would take the plea deal if that witness was my main source of evidence, if I thought I could prove the case without that witness I may discuss with my colleagues on there opinions on the situation.

Many times law enforcement are certain that a particular crime has been committed by a defendant. What is your response if there is not enough evidence to stand at a criminal trial? I will request any additional evidence that law enforcement can provide, if they can't provide anything we will have to put the case to the side if we simply don't have enough information to prove our case.

How would you handle a situation where a police officer wants a warrant signed or wants to file particular charges and you do not agree with his/her assessment? i would discuss it with the officer and see if we can come to a compromise, otherwise we can discuss it with a Judge or another prosecutor and see what they think of it, the judge would ultimately make the decision so maybe it would be best to see what they would say.

As part of the District Attorneys Office, if you become a paralegal you are entitled to a free education in law with the San Andreas Law School. This voids the $43,000 enrollment fee, as such this would tie you into a 2 month contract upon passing the bar exam. Do you agree to this condition? Yes

Do you have any previous experience as a prosecutor? If so please detail this below. I was previously a prosecutor on RivalryRP and I held this position for the entire time I was there. After this I was a prosecutor on NegativeDeadRP as well as RetweetRP. Prior to RivalryRP I was a defense attorney.

Do you understand that if accepted as a member of the District Attorneys Office you will be expected to maintain a high level of professionalism as well as follow the law? You also agree to not share any confidential information you obtain as a member of the District Attorneys Office with any civilians or friends/family that are not employed within the District Attorneys Office. Yes
